SimplyInstrumental.com Acceptable Use Policy
1. INTRODUCTION
SimplyInstrumental.com's Acceptable Use Policy ("AUP") is intended to help enhance the use of the Internet by preventing unacceptable use. All users of SimplyInstrumental.com's Internet site (the "site")-those who access some of our site but do not have accounts ("Visitors"), as well as those who beg and plead with us to pay a monthly service fee to subscribe to the site even though we continue to explain that we don't have a monthly service fee ("losers")-must comply with this AUP. We support the free flow of information and ideas over the Internet and as a result of having actual lives do not actively monitor use of the site under most circumstances. Similarly, we do not exercise editorial control over the content of any Web site, electronic mail transmission, news group, or other material created or accessible through the site, except for certain proprietary websites of which we still have no real control, but we like to dress up in our suits and ties, march into their buildings flashing our fake ID badges - looking very official - and scare them into believing we're with the IRS and they're about to recieve an audit....whooo, talk about fun! However, in accordance with our Internet Service Agreement (which neither of us really remember signing), we may remove any materials that, in our sole discretion, may be illegal, may subject us to liability, or which may violate this AUP. SimplyInstrumental.com may cooperate with legal authorities and/or third parties in the investigation of any suspected or alleged crime or civil wrong because we sure aren't going to the pokey for something we didn't do, geez! Your violation of this AUP may result in the suspension or termination of either your access to the site and/or your SimplyInstrumental.com account or other actions as detailed in Section 3. Consider yourself warned.
2. VIOLATIONS OF SimplyInstrumental.com'S ACCEPTABLE USE POLICY
The following constitute violations of this AUP:
a.Illegal use. Using the site to transmit any material (by email, uploading, posting, or otherwise) that, intentionally, unintentionally, or even accidentally violates any applicable local, state, national or international law, or any rules or regulations promulgated thereunder including the act of trying to explain to others what the word "promulgated" means.
b.Harm to minors. Using the site to harm, or attempt to harm, minors in any way and since most of you ARE minors there'll be no harm or attempt to harm yourselves or each other, understand? Don't make me come down there. It won't be pretty.
c.Threats. Using the site to transmit any material (by email, uploading, posting, or otherwise) that threatens or encourages bodily harm or destruction of property even if it's your own.
d.Harassment. Using the site to transmit any material (by email, uploading, posting, or otherwise) that harasses another. Another 'what' is at our discretion and may change on an hourly basis, so stop by every so often to insure it's not changed.
e.Fraudulent activity. Using the site to make fraudulent offers to sell or buy products, items, or little brothers/sisters or to advance any type of financial scam such as "pyramid schemes," "Ponzi schemes," "chain letters" or the dreaded "send me your IM/Yahoo/MSN ID."
f.Forgery or impersonation. Attempting to impersonate any person other than yourself by using forged keystrokes or other identifying information is prohibited. The use of anonymous remailers or nicknames does not constitute impersonation because you're posing as no one, duh! Using deliberately misleading headers ("munging" headers) in news postings in order to avoid spam email address collectors is allowed. However, there will be absolutely no impersonation "munging" allowed anywhere near this site, you got it mister!?
g.Unsolicited commercial email/Unsolicited bulk email. Using the site to transmit any unsolicited commercial email or unsolicited bulk email. Activities that have the effect of facilitating unsolicited commercial email or unsolicited bulk email whether or not that email is commercial in nature, are prohibited. Unsolicited email from us however, is permitted and in fact encouraged.
h.Unauthorized access. Accessing, or the attempt to access the accounts of others, or to penetrate, or attempt to penetrate, security measures of SimplyInstrumental.com's or another entity's computer software or hardware, electronic communications system, or telecommunications system, whether or not the intrusion results in the corruption or loss of data. So, just take your "loser" self home and leave this stuff alone, alright!
i.Copyright or trademark infringement. Using the site to transmit any material (by email, uploading, posting, or otherwise) that infringes any copyright, trademark, patent, trade secret, or other proprietary rights of any third party, including, but not limited to, the unauthorized copying of copyrighted material, the digitization and distribution of photographs from magazines, books, or other copyrighted sources, and the unauthorized transmittal of copyrighted software. So don't think about 'munging' your MP3 files here, mister!
j.Collection of personal data. Using the site to collect, or attempt to collect, personal information about third parties without their knowledge or consent will be met with a strong talking to. Repeat offenders will be sent to bed without any supper OR dessert.
k.Reselling the site. Reselling the site without SimplyInstrumental.com's authorization would just be stupid. I mean, who in their right mind would buy our site - huh? That's just silly.
l.Network disruptions and unfriendly activity. Using the site for any activity which adversely affects the ability of other people or systems to use SimplyInstrumental.com site or the Internet (assuming that you still believe we aren't the Internet). This includes "denial of service" (DoS) attacks against another network host or individual user (aaanhoiu). Interference with or disruption of other network users, network site or network equipment is permitted and on occasion (depending upon who is is, may be encouraged). It is the Member's responsibility to ensure that their PC is configured in a secure manner. A Member may not, through action or inaction, allow others to use their PC for illegal or inappropriate actions. A Member may not permit their PC, through action or inaction, to be configured in such a way that gives a third party the capability to use their PC in an illegal or inappropriate manner. So Mr. Member, if that is in fact your real name, if you think we're not watching then you have another think coming...
m.News. SimplyInstrumental.com Members should use their best judgment when posting to any newsgroup. Many groups have charters, published guidelines, FAQs, or "community standards" describing what is and is not considered appropriate regardless of the fact that no one really understands or obeys them. But by telling you they're there we've eliminated our liability; isn't this a GREAT country! Usenet can be a valuable resource if used properly. The continued posting of off-topic articles is suggested in order to remind others that you're still patiently waiting for someone to answer your post to let you know just who they think are the top 10 marching bands of all time. Commercial advertisements are off-topic in most newsgroups, especially regional groups not specifically named for such. The presence of such articles in a group is not indicative of the group's "intended" use. Please familiarize yourself with basic Usenet netiquette before posting to a newsgroup. There will be a test later.
SimplyInstrumental.com considers "multiposting" to 10 or more groups within a two week sliding window to be a dare.
3.REPORTING VIOLATIONS OF SimplyInstrumental.com'S AUP
SimplyInstrumental.com requests that anyone who believes that there is a violation of this AUP direct the information to Director-Abuse Department, at: abuse@SimplyInstrumental.com. If available, please provide the following information:
The color and font of text used to commit the alleged violation
The date and time of the alleged violation, including the time zone or offset from GMT allowing for the multiple time zones in Indiana which we've never personnaly understood anyway. Is it Winter or Summer that we're on the same time as Indianapolis. Stupid time zones.
Evidence of the alleged violation including 8x10 glossy pictures with circles and arrows depicting the perpetrator(s) actions
Email with full header information provides all of the above (as long as you type it in ahead of time), as do syslog files (same requirement). Other situations will require different methods of providing the above information, like stalking the perpetrator and getting taped messages and photographs....not that we're recommending this type of activity, but if you're going to crack down on these violators sometimes you have to get tough.
SimplyInstrumental.com may take any one or more of the following actions in response to complaints:
issue warnings: written or verbal followed by a severe rationing of caffeine products
suspend the Member's car or movie privileges and ground them for 1 week intervals for each violation
suspend the Member's account at the local video rental store so they have to drive 10-15 miles out of their way to the next store
modify said post to reflect the "true" or "surely intended" meaning of the stated message in accordance with the acceptable use policy
bring legal action to enjoin violations and/or to collect damages, if any, resulting from the mistreatment of small woodland creatures.
4. REVISIONS TO THIS ACCEPTABLE USE POLICY
SimplyInstrumental.com reserves the right to revise, amend, modify or dispose of this AUP, our Internet Service Agreement (I still don't recall that one) and our other policies and agreements at any time of day or night and in any manner we feel appropriate - like posting it in a cursive font size 4 so that it's not possible to read and having it disappear on random intervals - don't put it past us, really. Notice of any revision, amendment, or modification will not likely occur, so what you see is what you get. Have a great day.
